2. Important Information and Terms and Conditions for Application of Standard Chartered Credit Card – General Information and Terms and Conditions
a. Documents Required
Please enclose copies of documents below. Please note that copies of the documents submitted must be complete, legible and without any masked information. The application form and any documents submitted will not be returned. Standard Chartered Bank (Hong Kong) Limited (the “Bank”) may request additional documents from you for approval purpose.

Address proof
  • Your latest residential address proof showing your name (e.g. utility bill or bank statement issued within the last 3 months)
  • If the address provided in the application form (“Stated Address”) is different from the address as shown on the residential address proof (“RAP Address”) provided, RAP Address may supersede the Stated Address at the sole discretion of the Bank
Income proof
  • Your latest 1 month’s salary slip OR Bank Statements/Passbook showing your name, account number and salary entries
    (latest 3 months’ records are required for irregular income earners)
  • If you are self-employed, please enclose your Business Registration Certificate AND latest Tax Demand Note

Remarks: The Bank will review all information you have provided when assessing your application. Final approval is subject to the Bank’s discretion.


b. General Terms and Conditions for Credit Card Application
  1. If you currently hold a valid Standard Chartered Credit Card and you choose to apply for the same card type(s) in this application, the Bank reserves the right not to process the application for that card type(s) and process the application for the other credit card(s) applied under this application.
  2. The Bank reserves the right to treat your credit card application for a certain card type(s) as application for another card type(s) and grant you the relevant type(s) of credit card as the Bank sees fit.
  3. The Bank may cancel or adjust the credit limit of any of your credit cards issued by the Bank in connection with your application, its approval or any subsequent application or approval, if any as the Bank deems it necessary.
  4. If you simultaneously choose to apply the same card type including but not limited to Standard Chartered Platinum Mastercard and Standard Chartered Visa Platinum Card, the Bank will process your application for herein as Standard Chartered Platinum Mastercard.
  5. Principal cardholders of Simply Cash Visa Card may choose the card design of the Simply Cash Visa Card that is available at the time of application. If the principal cardholder simultaneously applies for more than one card design of the Simply Cash Visa Card, subject to credit card approval, the Bank has the right to issue only one Simply Cash Visa Card with any card design to the principal cardholder at its sole and absolute discretion. In any case, once the application is submitted, any change on the choice of the card design of the Simply Cash Visa Card will not be accepted.
  6. Vertical Simply Cash Visa Card is for electronic use only, i.e. the transaction receipt data must be captured electronically and cannot be manually imprinted.
  7. If you apply for multiple credit cards in this application form and the Bank rejects any one of the applications made, the Bank reserves the right to cease processing the remaining applications without prior notice.
  8. You may, at any time without charge, choose not to have any temporary credit limit extension for your card. If you do not indicate your rejection on the temporary credit limit extension service (if applicable), you will be deemed to have given your consent to the Bank to grant the temporary credit limit extension service to your credit card(s). An Overlimit Charge is payable upon the outstanding balance debited in your card account over your granted credit limit in each credit card statement cycle. If you are staff of the Bank, you will be deemed to have chosen to opt-out on the temporary credit limit extension service to your credit card(s).

    Over-the-limit transactions can still happen even if you have opted-out from the temporary credit limit extension service and thus Overlimit Charge may be chargeable. The over-the-limit transactions include, but are not limited to, Octopus automatic add-value service, autopay, late posting of a transaction due to the mode of spending (such as online purchase and overseas purchase with foreign currency chosen as the settling currency), stand-in authorization waited to be run overnight and transactions made by Visa payWave or Mastercard contactless service (for applicable credit card only) which signature is not required for verification.   9. If you do not have any bank account with the Bank at the time of this application, the Bank will update your contact information into the Bank’s system(s) upon successful approval of the credit card. The Bank will issue SMS, email or letter for notifying you the updates accordingly.

    If you are an existing client, the update of your personal information is applicable to all account(s) with the bank, except Insurance or MPF service. The Bank will issue SMS, email or letter for notifying you the updates accordingly. The Bank will update your personal information into the Bank’s system(s) upon successful approval of the credit card.


c. Standard Chartered Credit Card Application – Important Notes
  1. By making an application, you have read and accepted all terms and conditions set out in this application form, its accompanying leaflet (if applicable) as well as all terms and conditions stated in the Client Terms and the applicable documents referred to in Part A of Client Terms, and the Credit Card Terms, highlights of which are appended in this application (“banking agreement“). You agree to be bound by them and any variation the Bank makes to its banking agreement.
  2. The minimum annual income requirement for respective card type is:

    Standard Chartered Simply Cash Visa Card, Standard Chartered Asia Miles Mastercard, Standard Chartered Smart Credit Card HKD96,000
    If you have multiple Standard Chartered Credit Cards, you shall have one approved credit limit which is to be shared among all Standard Chartered Credit Cards. Total monthly transactions of all your Standard Chartered Credit Cards will also be consolidated into one statement.
  3. The Bank will obtain credit report on you and any of its sureties, on more than one occasion (if the Bank considers necessary), from a credit reference agency when considering any application for credit. In the event you or any of its sureties wishes to access the credit report, upon request, the Bank will advise the contact details of the relevant credit reference agency.
  4. The Bank reserves the right to request the applicant to provide supporting document(s) for credit card approval purpose as the Bank sees fit.
  5. The Bank reserves the right to offer an alternative type of credit card instead of the card you apply.
  6. The approval of the credit card is subject to the final decision of the Bank.
  7. Any benefit offer (or welcome offer) for successful application is subject to availability and the Bank may change such offer at its discretion from time to time without notice to you.
  8. You may enquire about the status of your application by using the Standard Chartered Credit Card 24-Hour Customer Service Hotline at 2886 8868. Where your application is approved, before using the card, you will need to activate the card by using the Credit Card 24-Hour Automated Phone Enquiries System designated by the Bank for such purposes.
  9. You have read and understood the Bank’s “Notice to Customers and Other Individuals relating to the Personal Data (Privacy) Ordinance (“Ordinance“) and the Code of Practice on Consumer Credit Data” (“Notice“) which is available to you at any of Standard Chartered branches and/or on Standard Chartered website at sc.com/hk and forms part of its banking agreement. You agree that all information provided by you in connection with this application (including personal information) may be used and disclosed to such persons (whether in or outside Hong Kong) and for such purposes as set out in the Notice.
  10. The Bank reserves the right to amend the contents and all the terms and conditions contained on this website at any time.
  11. In case of inconsistency between the applicable terms and conditions on one hand and the provisions within the application form or this website, the former shall prevail.
  12. In case of inconsistency or conflict between the English and the Chinese versions, the English version shall prevail.


d. Highlight of the Banking Agreement (including Credit Card Terms)
Important Notes: You are suggested to read carefully the entire banking agreement. Your attention is particularly drawn to the following major terms and conditions:
  1. The terms of our banking agreement apply to the use of your credit card. If you do not agree with those terms, you may wish to terminate your credit card in accordance with the procedure in the Credit Card Terms.
  2. You must comply with the activation procedures we notify you from time to time.
  3. You must ensure that only the person issued with a credit card uses it.
  4. You are liable for all transactions made using your credit card or the card number on such credit card. You are also liable for all transactions made using a supplementary card or the card number on such supplementary card.
  5. You must ensure that your credit limit is not exceeded.
  6. You must pay the interest, fees and charges that apply to your credit card.
  7. You must pay at least the minimum payment due or minimum monthly repayment as set out in your statement. You remain liable to us even if you do not receive your periodic statement.
  8. The minimum payment due shall be the aggregate amount of items as set out in the Credit Card Terms or any minimum amount as set out in the tariff sheet, whichever amount is higher.
  9. If we do not receive your balance owing for your credit card on or before the due date set out in your statement, we may charge you (subject to any grace period in accordance with our usual practice or applicable law) the applicable involuntary charges, which we may debit from your account.
  10. We (and any other member of the Standard Chartered Group) may set off any amount we (or any other member of the Standard Chartered Group) owe you against any amount you owe us (or any other member of the Standard Chartered Group) (whether or not the obligation is matured or contingent). We (and each other member of the Standard Chartered Group) may also combine or consolidate all accounts. If we (or any other member of the Standard Chartered Group) combine accounts, any credit funds held by you in your accounts will be applied to adjust the amount owing by you in relation to your other accounts. We (and each other member of the Standard Chartered Group) may do so at any time (even if you are not in default).
  11. If we do not receive the minimum payment or minimum monthly repayment on or before the due date, you must pay for the applicable involuntary charges. You may not use your credit card until the minimum payment or minimum monthly repayment has been paid and we may suspend the use of your credit card.
  12. Despite any other terms of our banking agreement, subject to applicable law, we may at any time demand immediate payment of any amounts you owe us.
  13. If you think there is an error on your statement, you must notify us with details of such error within the period specified in the statement. If you do not do so, we will treat the statement as correct.
  14. If you are not comfortable with any changes we make to our banking agreement, you may terminate your credit card in accordance with the procedure in the Credit Card Terms.
  15. If your credit card or any supplementary card is lost or stolen, you will be liable for the use of the credit card and any supplementary card until such time you notify us that the card is lost or stolen. However, your liability will be limited to HKD500 if you have not acted fraudulently or with gross negligence and you have complied with the Security Procedures set out in our Client Terms.
  16. You are liable for your failure and that of any supplementary cardholder in complying with our banking agreement.
  17. If you or we end the account for a credit card, subject to any applicable law, you must immediately pay all amounts owing to us in connection with the credit card and any supplementary card.
  18. You may be liable for any transaction made using a supplementary card until it has been returned or until we are able to implement our procedures applicable to lost cards. We may impose any charges incurred from implementing such procedures.
  19. Our Client Terms include additional provisions relating to your liability to us and exclusions or limits on our liability.

e. Standard Chartered Smart Card Terms and Conditions
  1. All cardholders (“Cardholders”, including both the principal and supplementary cardholders) enjoy perpetual annual fee waiver.
  2. All Cardholders enjoy cash advance fee waiver for cash advance made over the counter or via Jetco ATM / Visa International ATM Network.
  3. All reimbursement charge in Smart Credit Card Account on foreign currency transactions incurred in or outside of Hong Kong and settling foreign currency transaction in Hong Kong Dollars incurred outside of Hong Kong SAR are waived.

    1. Settlements of all foreign currency transactions will be made in Hong Kong Dollars. All transactions effected in foreign currency will be converted from the transaction currency into Hong Kong Dollars at a wholesale market rate selected by Visa International from within a range of wholesale market rates or the government-mandated rate in effect on the date when Visa International process the transaction, such exchange rate may differ from the rate on the transaction date due to market fluctuation.
    2. You may sometimes be offered the option to settle foreign currency transactions in Hong Kong Dollars at the point of sale overseas. Such option is a direct arrangement offered by the overseas merchants and not the card issuer. In such cases, you are reminded to ask the merchants for the foreign currency exchange rates be applied before thetransactions are entered.
  4. The Bank reserves the right to amend the terms and conditions herein at any time. In case of disputes, the decision of Standard Chartered Bank (Hong Kong) Limited (the “Bank”) shall be final and binding.
  5. These terms and conditions should be read together with the Client Terms and the applicable documents referred to in part A of the Client Terms including the Credit Card Terms and the Terms and Conditions for Points Redemption that form the banking agreement between the Bank and the Cardholders.
  6. These terms and conditions shall be governed in accordance with the laws of the Hong Kong SAR and the Cardholders irrevocably submit to the non-exclusive jurisdiction of the competent court of the Hong Kong SAR.
  7. If there is any inconsistency or conflict between English and Chinese versions of these terms and conditions, the English version shall prevail.


f. Standard Chartered Smart Credit Card Rewards Scheme (“Rewards Scheme”) Terms and Conditions
  1. The Rewards Scheme is only applicable to the cardholders (“Cardholders”, including both the principal and supplementary cardholders) of Standard Chartered Smart Credit Card (“Card”) issued by Standard Chartered Bank (Hong Kong) Limited (the “Bank”).
  2. Upon successfully signing up for and issued with a Standard Chartered Smart Credit Card, the Bank will rebate a certain percentage (“CashBack Percentage”) of the amount of the Eligible Transactions (“Eligible Transactions”, as defined in Clause 3 below) in the form of CashBack reward (“CashBack”) to the Card account as shown in the table below:

    1. Details of “Smart Card Rewards Scheme” are shown on sc.com/hk/en/smartcard including 1. promotion period, 2. the “Designated Merchants” and 3. The total maximum amount of Eligible Transactions made at Designated Merchants that qualifies for the 5% CashBack Percentage within the promotion period.
    2. The 5% CashBack Percentage is applicable to Designated Merchants’ outlets in Hong Kong SAR only. Where Eligible Transactions are made using digital wallets, they will be eligible for the 5% CashBack Percentage only if the Designated Merchant’s name is reflected on the Credit Card Statement as part of the transaction description.
    3. Any amount in excess will be counted as Other Eligible Transactions.
    4. The details of the “Smart Card Reward Scheme” is subject to be changed by the Bank from time to time without any prior notice.
  3. “Eligible Transactions” means retail transactions (including online transactions and interest-free monthly instalment) and Octopus Automatic Add-Value transactions made with the Card but does NOT include the following:
    1. any transfer/top up transaction from the Card account to any account as designated by the Bank from time to time, including but not limited to, Octopus Wallet, Alipay account, transactions effected through Faster Payment System or using the FPS Services or services from non-card association and other digital payment account as may be made available by the Bank from time to time, insurance payment, bill payment transactions made through Standard Chartered Online Banking, Standard Chartered Phone Banking or JET Payment Services, phone order, mail order, transactions made at merchants in the gambling and betting, security brokers or dealers, non-financial institutions (including but not limited to the purchase of foreign currency, money orders and travelers cheques), financial institutions (including but not limited to the purchase of merchandise and services from banks, savings and loans, thrifts and credit unions and face-to-face cash disbursement), wire transfer, money orders and wholesale purchase of precious stones and metals, watches and jewellery, according to the merchant codes issued by Visa International from time-to-time, cash advances, balance transfers, “Instalment Credit” amounts, “Credit-to-Cash Preferential Annual Rate” amounts, tax payment, financial charges and fees;
    2. any unposted, cancelled, refunded, falsified or unauthorised transactions.
    CashBack for Eligible Transactions that are made up of interestfree monthly instalment will be awarded to the Card account on a monthly basis and only for the instalment amount that is posted to the Card account during the relevant month.
  4. The CashBack earned will be shown on the 360° Rewards Redemption Platform after the relevant Eligible Transaction is posted, and will not be automatically credited to the Card account, but can be freely redeemed for CashBack under the online catalogue of the platform. The CashBack will be given in Hong Kong dollars and the minimum threshold for CashBack redemption per Card account is HKD50 per account redemption. For details, please refer to Section CashBack Redemption of Terms and Conditions for Points Redemption.
  5. CashBack will be calculated by rounding down to the nearest 1 cent.
  6. Eligible Transactions conducted by principal and all supplementary cards (if any) under the same Card account will be counted collectively in calculating the CashBack.
  7. CashBack is non-transferable.
  8. In the event that any CashBack has been used or credited into Cardholders’ Card account but the transaction(s) that form(s) part or all of the CashBack is cancelled or refunded subsequently, the Bank has the right to charge to the Card account a monetary amount equivalent to the value of the CashBack used or credited without prior notice to the Cardholders.
  9. If the Card account is voluntarily or involuntarily closed, all CashBack (whether credited to the Card account or not) will be immediately forfeited.
  10. The Bank reserves the right not to award any CashBack if the Card account is invalid or not in good financial standing, or if the Cardholders have failed to pay any minimum payment due on or before the due date specified in the relevant monthly statement in the preceding 12 months.
  11. The Bank reserves the right to alter or terminate the Rewards Scheme and amend the terms and conditions herein at any time, including but not limited to the CashBack Percentage. In case of disputes, the decision of the Bank shall be final and binding.
  12. These terms and conditions should be read together with the Client Terms and the applicable documents referred to in part A of the Client Terms including the Credit Card Terms and the Terms and Conditions for Points Redemption that form the banking agreement between the Bank and the Cardholders.
  13. These terms and conditions shall be governed in accordance with the laws of the Hong Kong SAR and the Cardholders irrevocably submit to the non-exclusive jurisdiction of the competent court of the Hong Kong SAR.
  14. If there is any inconsistency or conflict between English and Chinese versions of these terms and conditions, the English version shall prevail.


g. Terms and Conditions of 3-months unlimited Interest-free Instalment Plan for Standard Chartered Smart Credit Card
  1. The 3-months unlimited Interest-free Instalment Plan (“3-months Interest-free Instalment”) is only applicable to the cardholders (“Cardholders”, including both the principal and supplementary cardholders) of Standard Chartered Smart Credit Card (“Card”) issued by Standard Chartered Bank (Hong Kong) Limited (“Bank”).
  2. Upon successfully apply for a credit card statement instalment plan (“Credit Card Statement Instalment Plan”) with a tenor of 3 months through SC Mobile App or online and the Bank approving such application, the Cardholder will be entitled to interest and handling fee free period for the first 3-months of the Credit Card Statement Instalment Plan (“Promotion”).
  3. Upon successful application for the Credit Card Statement Instalment Plan and where the application is approved by the Bank, the Bank will reverse HKD1 CashBack for every HKD180 instalment amount applied. The CashBack reversed will be shown on the 360° Rewards Redemption Platform. CashBack reversal will be calculated by rounding down to the nearest 1 cent.
  4. If cardholder early repays the approved instalment amount of Credit Card Statement Instalment Plan, the Bank reserves the right to terminate the Promotion and/or deduct the value of any rebate awarded from any of the cardholder’s account(s) without prior notice.
  5. The Bank reserves the right to alter or terminate the above 3-months Interest-free Instalment and amend the terms and conditions herein at any time. In case of disputes, the decision of the Bank shall be final and binding.
  6. These terms and conditions should be read together with the Terms and Conditions of Standard Chartered Credit Card Statement Instalment Plan.
  7. These terms and conditions shall be governed in accordance with the laws of the Hong Kong SAR and the Cardholders irrevocably submit to the non-exclusive jurisdiction of the competent court of the Hong Kong SAR.
  8. If there is any inconsistency or conflict between English and Chinese versions of these terms and conditions, the English version shall prevail.


h. Welcome Offer Terms and Conditions

Welcome Offer Applicable to Standard Chartered Smart Credit Card
  1. Only applicable to New Cardholders who have successfully applied for and being issued with the principal card of Standard Chartered Smart Credit Card (“Smart Card”) by the Bank.
  2. The Welcome Offer consists of up to HKD1,500 CashBack which is made up of up to HKD1,000 CashBack for spending and up to HKD500 CashBack for recurring transactions:-
    • New Cardholders will be entitled to 25% CashBack on Eligible Transactions spending made with the newly approved Smart Card within the first 2 months from the date of card issuance, subject to a maximum of HKD1,000 CashBack.
    • CashBack to be rewarded under this “Up to HKD1,000 CashBack for Spending” includes the CashBank earned from the prevailing Standard Chartered Smart Credit Card Rewards Scheme (“Smart Card Rewards Scheme”)
    • New Cardholders will be entitled to HKD100 CashBack for each set up of merchant eligible recurring transactions with merchant and with those recurring transactions being settled successfully with the newly approved Smart Card within the first 2 months from the date of card issuance, subject to a maximum of HKD500 CashBack.
    • Eligible recurring transactions is a periodic automatic payment agreement between cardholder and merchant which are defined by the specific merchants, Acquiring Banks and VISA from time to time. The Bank does not define those recurring transactions. Any autopay authorization between cardholder and the Bank would not treat as eligible recurring transactions.
    • Transactions made with insurance companies or associated with insurance are not considered as eligible recurring transactions.

i. Credit Card Application Declaration
To: Standard Chartered Bank (Hong Kong) Limited (hereinafter called the “Bank”, “we”, “us” or “our” including our successors and assigns)

By submitting this application:
  1. you (being the person named as the “applicant” in the application) represent and warrant that all information (including any documents) you have given to us(being each member of the Standard Chartered Group identified in the application or the approval as the person providing the facility, product or service to you, and its successors and assigns) in connection with this application is correct, complete and not misleading – important note: if this is not the case you may be personally liable. The Bank will review all information you have provided when assessing your application. Final approval is subject to the Bank’s discretion. You also authorize us to verify from any source we may choose. If you are a principal card applicant, you further represent and confirm that the principal card applicant is at least 18 years of age;
  2. you acknowledge that we may decline your application in its entirety or in part (in respect of any one or more particular credit card(s) you are applying for in this application) without giving you any reason for doing so; if this happens, no contractual relationship arises between you and us in respect of any credit card(s) requested in this application which we have declined to provide to you;
  3. you agree and confirm that:
    • our Client Terms and the applicable documents referred to in Part A of our Client Terms, including the Credit Card Terms and other prevailing terms and conditions, Terms and Conditions for e-Statement Service, product brochure, important notes and promotional terms (if any), and any other document forming part of our banking agreement (collectively “the banking agreement”) have been made available to you at any of our branches and on our website at sc.com/hk;
    • you have read and understood the banking agreement and you agree to be bound by it ; and
    • you are bound by any variation we make to the banking agreement, in accordance with the banking agreement– important note: in particular, you understand that by entering into the banking agreement you give indemnities, authorisations, consents and waivers and agree to limitations on our liability;4.you further agree and confirm that: (i) a highlight of the banking agreement has been provided to you as appended in this application form; (ii) unless you have indicated your choice to receive a hard copy, you agree to receive an electronic copy of the banking agreement; (iii) you have read and understood the banking agreement and/or a highlight of it; and (iv) you agree to be bound by the banking agreement;
  4. you further agree and confirm that: (i) a highlight of the banking agreement has been provided to you as appended in this application form; (ii) unless you have indicated your choice to receive a hard copy, you agree to receive an electronic copy of the banking agreement; (iii) you have read and understood the banking agreement and/or a highlight of it; and (iv) you agree to be bound by the banking agreement;
  5. you acknowledge receipt of and confirm that you have read and agreed to be bound by the Notice to Customers and Other Individuals relating to the Personal Data (Privacy) Ordinance (“Ordinance”) and the Code of Practice on Consumer Credit Data (“Notice”) which has been available to you at any of our branches and on our website at sc.com/hk; you further agree that the Notice shall form part of the banking agreement; you agree that all information provided by you in this application form, and any other personal data collected by us about you or that you may provide to us from time to time before, during or after this application, may be used and disclosed for such purposes and to such persons (whether the recipient is located in the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”) or another country including a country that does not offer the same level of data protection as Hong Kong) for the purposes described in, and otherwise in accordance with our policies on use and disclosure of personal data as set out in the Notice, which may be subject to change from time to time;
  6. you represent and warrant that you have complied and will comply with all applicable laws (including any foreign exchange restrictions) in connection with the banking agreement;
  7. You confirm that:
    • none of your credit cards have been cancelled due to payment default;
    • you do not have any payments overdue by more than one month on any loans or credit cards you have with other financial institutions; and
    • you are not and have never been bankrupt and you have no intention to petition nor are you currently petitioning for bankruptcy;
    • you understand and agree that the Bank may, at its sole discretion, decide whether to approve this application by reference to the overall banking relationship, total asset balance or deposits held with the Bank if you are an existing banking client;
    • unless otherwise specified, you confirm that you are not a relative of any of our or our subsidiary’s or fellow subsidiary’s directors, employees with lending authority or shareholders holding 10% or more of our issued shares (“specified persons”). Moreover, none of the specified persons mentioned herein is your guarantor of any other matters. You agree to notify us in writing as soon as reasonably practicable if you subsequently become aware of any change in the aforesaid status;
    • We will serve a written notice to you at your correspondence address set out in the application form if we accept your application;
    • the Credit Card Terms and any important notes and related terms that we have provided to you in connection with the credit card shall form part of the banking agreement and you confirm that you have read and understood them and agreed to be bound by them;
    You understand and agree that for the purpose of reviewing your existing credit facilities, we may access your data held with a credit reference agency in accordance with the provisions of the Code of Practice on Consumer Credit Data. We may also access your data from the credit reference agency from time to time for the same application if the application has remained outstanding for over 30 days. You understand and agree that the Bank reserves the right to cancel or not to proceed with this application if the required documents and/or application information are not provided within 30 days from the date of the application, and/or the relevant requirement(s) is not met. You further confirm and agree that we may give any information in connection with this application (including your personal information) to the parties (whether situated in or outside of the Hong Kong Special Administrative Region of the People’s Republic of China) and for the purposes as set out in the Notice.
    You understand that sales staff of the Bank receives remuneration with reference to the performance of the relevant staff for promoting various banking and related services that provided by the Bank. The remuneration structure is subject to review by the Bank from time to time and includes salaries, incentives, bonuses, etc.

    If there is any inconsistency between the English version and the Chinese version of this application form, the English version prevails.

3. Notice to customers and other individuals relating to the Personal Data (Privacy) Ordinance (“Ordinance”) and the Code of Practice on Consumer Credit Data
  1. From time to time, it is necessary for data subjects to supply the Bank with data in connection with matters such as:-
      1. the opening or operation of accounts,
      2. the establishment or maintenance of facilities; and/or
      3. the establishment or operation or provision of products or services offered by or through the Bank (which include banking, cards, financial, insurance, fiduciary, securities and/or investments products and services as well as products and services relating to these); (collectively, Facilities, Products and Services), and/or
    1. the receipt of supplies and services to the Bank.
  2. Failure to supply such data may result in the Bank being unable to establish, maintain or provide Facilities, Products and Services to data subjects.
  3. It is also the case that data are collected, directly or indirectly, by the Bank from data subjects transacting with or through the Bank in the ordinary course of the Bank’s business, including (without limitation) information received from third parties, the public domain, collected through use of the websites, cookies and electronic banking services of the Standard Chartered Group, and/ or when data subjects write cheques or deposit money or effect transactions through cards.
  4. Data relating to a data subject may be used for any one or more of the following purposes:-
    1. processing applications from the data subject (including assessing the merits and/or suitability of the data subject’s application(s)) for the establishment of Facilities, Products and Services;
    2. operating, maintaining and providing Facilities, Products and Services to the data subject, including to enable the Bank or any member of the Standard Chartered Group to fulfil any contract for Facilities, Products and/ or Services that a data subject has requested and/or to understand the overall picture of the relationship of a data subject with the Standard Chartered Group by linking data in respect of all accounts such data subject is connected to;
    3. conducting credit checks on the data subject (whether in respect of an application for Facilities, Products and Services or during regular or special review which normally will take place once or more each year);
    4. creating and maintaining the Bank’s credit scoring models;
    5. maintaining credit history of the data subject for present and future reference;
    6. assisting other financial institutions to conduct credit checks and collect debts;
    7. ensuring ongoing credit worthiness of the data subject;
    8. designing banking, cards , financial, insurance, securities and investment services or related products for data subject’s use;
    9. marketing services, products and other subjects (please see further details in paragraph (g) below);
    10. determining the amount of indebtedness owed to or by data subjects;
    11. enforcement of data subjects’ obligations, to the Bank or any other member of the Standard Chartered Group, including but not limited to the collection of amounts outstanding from data subjects and those providing security for data subjects’ obligations;
    12. meeting or complying with any obligations, requirements or arrangements for disclosing and using data that apply to the Bank or any other member of the Standard Chartered Group or that it is expected to comply according to:-
      1. any law or regulation binding on or applying to it within or outside Hong Kong existing currently and in the future (e.g. the Inland Revenue Ordinance and its provisions including those concerning automatic exchange of financial account information);
      2. any guidelines or guidance given or issued by any legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers within or outside Hong Kong existing currently and in the future (e.g. guidelines or guidance given or issued by the Inland Revenue Department including those concerning automatic exchange of financial account information);
      3. any present or future contractual or other commitment with local or foreign legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers that is assumed by or imposed on the Bank or any member of the Standard Chartered Group by reason of its financial, commercial, business or other interests or activities in or related to the jurisdiction of the relevant local or foreign legal, regulatory, governmental, tax, law enforcement or other authority, or self-regulatory or industry bodies or associations;
    13. meeting or complying with any obligations, requirements, policies, procedures, measures or arrangements for sharing data and information within the Standard Chartered Group and/or any other use of data and information in accordance with any group-wide programmes for compliance with sanctions or prevention or detection of money laundering, terrorist financing or other unlawful activities;
    14. enabling an actual or potential assignee of all or any part of the business and/or asset of the Bank or participant or sub-participant of the Bank’s rights in respect of the data subject, to evaluate the transaction intended to be the subject of the assignment, participation or sub-participation;
    15. in connection with any member of the Standard Chartered Group defending or responding to any legal, governmental, or regulatory or quasi-governmental related matter, action or proceeding (including any prospective action or legal proceedings), including where it is in the legitimate interests of the Bank or any member of the Standard Chartered Group to seek professional advice, for obtaining legal advice or for establishing, exercising or defending legal rights;
    16. in connection with any member of the Standard Chartered Group making or investigating an insurance claim or responding to any insurance related matter, action or proceeding;
    17. organizing and delivering seminars for the data subjects;
    18. managing, monitoring and assessing the performance of any agent, contractor or third party service provider who provides administrative, telecommunications, computer, payment or securities clearing or other services to the Bank in connection with the establishment, operation, maintenance or provision of Facilities, Products and Services; and/or
    19. any other purposes relating to the purposes listed above.
  5. Data the Bank holds relating to a data subject is kept confidential but the Bank may provide, transfer or disclose such data or information to any one or more of the following parties (whether within or outside Hong Kong*) for the purposes set out in paragraph (d):-
    1. any agent, contractor or third party service provider who provides administrative, telecommunications, computer, payment or securities clearing or other services to the Bank in connection with the establishment, operation, maintenance or provision of Facilities, Products and Services;
    2. any other person under a duty of confidentiality to the Bank including any other member of the Standard Chartered Group which has undertaken to keep such information confidential;
    3. the drawee bank providing a copy of a paid cheque (which may contain information about the payee) to the drawer;
    4. credit reference agencies and, in the event of default, to debt collection agencies;
    5. any person or entity to whom the Bank or any other member of the Standard Chartered Group is under an obligation or otherwise required to make disclosure under the requirements of any law or regulation binding on or applying to the Bank or any other member of the Standard Chartered Group, or any disclosure under and for the purposes of any guidelines, guidance, directives, rules, codes, circulars or other similar documents issued or given by any legal, regulatory, governmental, tax, law enforcement or other authorities, or self- regulatory or industry bodies or associations of financial services providers with which the Bank or any other member of the Standard Chartered Group is expected to comply, or any disclosure pursuant to any contractual or other commitment of the Bank or any other member of the Standard Chartered Group with local or foreign legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers, all of which may be within or outside Hong Kong and may be existing currently and in the future;
    6. any financial institution and merchant acquiring company with which a data subject has or proposes to have dealings;
    7. any actual or proposed assignee of all or any part of the business and/or asset of the Bank or participant or sub-participant or transferee of the Bank’s rights in respect of the data subjects;
    8. any party giving or proposing to give a guarantee or third party security to guarantee or secure the data subject’s obligations; and/ or
      1. any member of the Standard Chartered Group which may include a Head Office function acting as a data controller in respect of data subject’s data;
      2. third party financial institutions, insurers, credit card companies, securities and investment services providers;
      3. third party reward, loyalty, co-branding and privileges programme providers;
      4. co-branding partners of the Bank and/or any member of the Standard Chartered Group (the names of such co-branding partners can be found in the application form(s) for the relevant services and products, as the case may be);
      5. charitable or non-profit making organisations; and
      6. external service providers (including but not limited to mailing houses, telecommunication companies, telemarketing and direct sales agents, call centres, data processing companies and information technology companies) that the Bank engages for the purposes set out in paragraph (d)(ix) above.

    1. With respect to data in connection with mortgages applied by a data subject (in any capacity) on or after 1 April 2011, the following data relating to the data subject (including any updated data of any of the following data from time to time) may be provided by the Bank, on its own behalf and/or as agent, to a credit reference agency:-
      1. full name;
      2. capacity in respect of each mortgage (as borrower, mortgagor or guarantor, and whether in the data subject’s sole name or in joint names with others);
      3. Hong Kong Identity Card Number or travel document number;
      4. date of birth;
      5. correspondence address;
      6. mortgage account number in respect of each mortgage;
      7. type of the facility in respect of each mortgage;
      8. mortgage account status in respect of each mortgage (e.g., active, closed, write-off (other than due to a bankruptcy order), write-off due to a bankruptcy order); and
      9. if any, mortgage account closed date in respect of each mortgage.
    2. The credit reference agency will use the above data supplied by the Bank for the purposes of compiling a count of the number of mortgages from time to time held by the data subject with credit providers in Hong Kong, as borrower, mortgagor or guarantor respectively and whether in the data subject’s sole name or in joint names with others, for sharing in the consumer credit database of the credit reference agency by credit providers (subject to the requirements of the Code of Practice on Consumer Credit Data approved and issued under the Ordinance).
    3. The Bank may from time to time access the mortgage count held by the credit reference agency in the course of:-
      1. considering mortgage loan application(s) made by the data subject (in any capacity);
      2. reviewing any credit facility (including mortgage loan) granted or to be granted to the data subject (in any capacity) which is in default for a period of more than 60 days with a view to putting in place any debt restructuring, rescheduling or other modification of the terms of such credit facility by the Bank;
      1. reviewing any credit facility (including mortgage loan) granted or to be granted to the data subject (in any capacity), where there is in place any debt restructuring, rescheduling or other modification of the terms of such credit facility between the Bank and the data subject consequent upon a default in the repayment of such credit facility for implementing such arrangement, and/or
      2. reviewing any credit facility (including mortgage loan) granted or to be granted to the data subject (in any capacity), with a view to putting in place any debt restructuring, rescheduling or other modification of the terms of any credit facility initiated by the request of the data subject.
    4. The Bank may from time to time access the mortgage count held by the credit reference agency in the course of (after 31 March 2013):-
      1. reviewing and renewing mortgage loans granted or to be granted to the data subject (in any capacity); and/or
      2. considering the application for credit facility (other than mortgage loan) by the data subject (in any capacity other than mortgagor) and/or reviewing or renewing any facility (other than mortgage loan) granted or to be granted to the data subject (in any capacity other than mortgagor), in each case where such facility is in an amount not less than such level or to be determined by a mechanism as prescribed or approved by the Privacy Commissioner for Personal Data from time to time.
  1. USE OF DATA IN DIRECT MARKETING
    The Bank intends to use a data subject’s data in direct marketing and the Bank requires the data subject’s consent (which includes an indication of no objection) for that purpose. In this connection, please note that:-
    1. the name, contact details, products and services portfolio information, transaction pattern and behaviour, financial background and demographic data of a data subject held by the Bank from time to time may be used by the Bank in direct marketing;
    2. the following classes of services, products and subjects may be marketed:-
      1. financial, insurance, fiduciary, investment services, credit card, securities, investment, banking and related services and products;
      2. reward, loyalty or privileges programmes and related services and products;
      3. services and products offered by the Bank’s co-branding partners (the names of such co-branding partners can be found in the application form(s) for the relevant services and products, as the case may be); and
      4. donations and contributions for charitable and/or non-profit making purposes;
    3. the above services, products and subjects may be provided or (in the case of donations and contributions) solicited by the Bank and/ or:-
      1. any member of the Standard Chartered Group;
      2. third party financial institutions, insurers, credit card companies, securities and investment services providers;
      3. third party reward, loyalty, co-branding or privileges programme providers;
      4. co-branding partners of the Bank and/or any member of the Standard Chartered Group (the names of such co-branding partners can be found in the application form(s) for the relevant services and products, as the case may be); and
      5. charitable or non-profit making organisations;
    4. in addition to marketing the above services, products and subjects itself, the Bank also intends to provide the data described in paragraph (g)(i) above to all or any of the persons described in paragraph (g)(iii) above for use by them in marketing those services, products and subjects, and the Bank requires the data subject’s written consent (which includes an indication of no objection) for that purpose;
    5. the Bank may receive money or other property in return for providing the data to the other persons in paragraph (g)(iv) above and, when requesting the data subject’s consent or no objection as described in paragraph (g)(iv) above, the Bank will inform the data subject if it will receive any money or other property in return for providing the data to the other persons.
    If a data subject does not wish the Bank to use or provide to other persons his/her data for use in direct marketing as described above, the data subject may exercise his/her opt-out right by notifying the Bank.
  2. Under and in accordance with the terms of the Ordinance and the Code of Practice on Consumer Credit Data approved and issued under the Ordinance, any data subject has the right:-
    1. to check whether the Bank holds data about him and/or access to such data;
    2. to require the Bank to correct any data relating to him which is inaccurate;
    3. to ascertain the Bank’s policies and procedures in relation to data and to be informed of the kind of personal data held by the Bank and/or he/she has access to;
    4. to be informed on request which items of data are routinely disclosed to credit reference agencies or debt collection agencies, and be provided with further information to enable the making of an access or correction request to the relevant credit reference agency or debt collection agency; and
    5. in relation to any account data (including, for the avoidance of doubt, any account repayment data) which has been provided by the Bank to a credit reference agency, to instruct the Bank, upon termination of the account by full repayment, to make a request to the credit reference agency to delete such account data from its database, as long as the instruction is given within five years of termination and at no time was there any default of payment in relation to the account, lasting in excess of 60 days within five years immediately before account termination. Account repayment data includes amount last due, amount of payment made during the last reporting period (being a period not exceeding 31 days immediately preceding the last contribution of account data by the Bank to a credit reference agency), remaining available credit or outstanding balance and default data (being amount past due and number of days past due, date of settlement of amount past due, and date of final settlement of amount in default lasting in excess of 60 days (if any)).
  3. In the event of any default of payment relating to an account, unless the amount in default is fully repaid or written off (other than due to a bankruptcy order) before the expiry of 60 days from the date such default occurred, the account repayment data (as defined in paragraph (h)(v) above) may be retained by the credit reference agency until the expiry of five years from the date of final settlement of the amount in default.
  4. In the event any amount in an account is written- off due to a bankruptcy order being made against a data subject, the account repayment data (as defined in paragraph (h)(v) above) may be retained by the credit reference agency, regardless of whether the account repayment data reveal any default of payment lasting in excess of 60 days, until the expiry of five years from the date of final settlement of the amount in default or the expiry of five years from the date of discharge from a bankruptcy as notified by the data subject with evidence to the credit reference agency, whichever is earlier.
  5. Without limiting the generality of the foregoing, the Bank may from time to time access the personal and account information or records of a data subject held by the credit reference agency for the purpose of reviewing any of the following matters in relation to the existing credit facilities granted to a data subject or a third party whose obligations are guaranteed by a data subject:-
    1. an increase in the credit amount;
    2. the curtailing of credit (including the cancellation of credit or a decrease in the credit amount); and
    3. the putting in place or the implementation of a scheme of arrangement with the data subject or the third party.
  6. The Bank may have obtained a credit report on a data subject from a credit reference agency in considering any application for credit. In the event a data subject wishes to access the credit report, the Bank will advise the contact details of the relevant credit reference agency.
  7. Data of a data subject may be processed, kept and transferred or disclosed in and to any country as the Bank or any person who has obtained such data from the Bank referred to in (e) above considers appropriate. Such data may also be processed, kept, transferred or disclosed in accordance with the local practices and laws, rules and regulations (including any governmental acts and orders) in such country.
  8. In accordance with the terms of the Ordinance, the Bank has the right to charge a reasonable fee for the processing of any data access request.
  9. Data subjects located in the European Union may also have the following additional rights:-
    1. the Bank or any other member of the Standard Chartered Group will use profiling, including behavioral analysis, to assist in providing data subjects with better Facilities, Products and/or Services, to make decisions and to prevent money laundering, terrorism, fraud and other financial crime, for example profiling will help to try and detect whether use of a credit card may be fraudulent. If any profiling will result in an automated decision relating to a data subject who is an accountholder, we will let the accountholder know and the accountholder will have the right to discuss the decision with the Bank;
    2. in some circumstances a data subject has the right to ask the Bank to delete the personal data of such data subject, for example if the Bank no longer has a valid reason to process it;
    3. in some circumstances a data subject may have the right to object to how the Bank processes the personal data of such data subject but this does not mean that the data subject can decide or choose how the Bank processes the personal data other than in relation to marketing. If a data subject has any concerns about how the Bank processes his/her/its personal data, such data subject should discuss this at a branch or with a relationship manager. The Bank may not be able to offer Facilities, Products or Services if the data subject does not want the Bank to process the personal data the Bank considers necessary to process to provide such Facilities, Products or Services;
    4. in some circumstances a data subject may have the right to restrict how the personal data of such data subject is processed;
    5. in some circumstances a data subject may have the right to request the personal data that has been given to the Bank in a machine readable format. An accountholder may already be able to do this through online banking in relation to banking transactions;
    6. a data subject has the right to complain to the Privacy Commissioner for Personal Data, or if the data subject is located in the European Union, the UK Information Commissioner. Details can be provided by emailing privacy@sc.com
  10. The person to whom requests for access to or correction of data held by the Bank, or for information regarding the Bank’s data policies and practices and kinds of data held by the Bank are to be addressed is as follows:

  11. Nothing in this document shall limit the rights of data subjects under the Ordinance.
  12. Security:-
    1. The security of personal data is important to the Bank. The Bank has technical and organisational security measures in place to safeguard each the personal data of each data subject. When using external service providers, the Bank requires that they adhere to security standards mandated by the Bank and the Standard Chartered Group. The Standard Chartered Group may do this through contractual provisions, including any such provisions approved by a privacy regulator, and oversight of the service provider. Regardless of where personal data is transferred, the Bank takes all steps reasonably necessary to ensure that personal data is kept securely.
    2. Data subject(s) should be aware that the Inter net is not a secure form of communication and they must not send the Bank any personal data over the Internet as this carries with it risks including the risk of access and interference by unauthorised third parties. Information passing over the Internet may be transmitted internationally (even when sender and recipient are located in the same country) via countries with weaker privacy and data protection laws than in the country of residence of a data subject.
  13. The Bank and the Standard Chartered Group retain personal data in line with applicable legal and regulatory obligations and for business and operational purposes. In the majority of cases this will be for seven years from the end of a data subject’s relationship with the Standard Chartered Group.
  14. To the extent permitted by law, the Bank and other members of the Standard Chartered Group may record and monitor electronic communications with data subjects to ensure compliance with legal and regulatory obligations and internal policies for the purposes outlined at paragraph (d) above.
  15. Data subjects should also read the cookie policy when using the Bank’s online services.

In this document, unless inconsistent with the context or otherwise specified, the words in italic shall have the following meanings:-

account(s) means, for each facility, service or product which the Bank may from time to time make available to the data subjects, the account that is, opened and/ or maintained in respect of it from time to time.

accountholder(s) means holder(s) of an account, and includes joint accountholder(s) in case there is more than one holder for an account.

card means an ATM card, a debit card, a credit card, or a revolving card or all of them, as the context requires.

data subject(s) has the meaning given to it in the Ordinance and includes applicants or accountholders for Facilities, Products and Services, customers, security providers, referees, corporate officers and managers, (e.g. authorized signatories, contact persons, company secretary, directors, shareholders, beneficial owners of a corporate), suppliers, agents, contractors, service providers and other contractual counterparties and any third party transacting with or through the Bank.

disclose, disclosing or disclosure, in relation to personal data, includes disclose or disclosing information inferred from the data.

Hong Kong means the Hong Kong Special Administrative Region.

in any capacity means whether as a borrower, mortgagor or guarantor and whether in the data subject’s sole name or joint names with others.

mortgage count means the number of mortgage loans held by the data subject (in any capacity) with credit providers in Hong Kong from time to time.

Standard Chartered Group means each of or collectively Standard Chartered PLC and its subsidiaries and affiliates (including each branch or representative office).

Please circulate this document to any and all data subject(s) relating to your account(s) at our Bank. Should there be any inconsistencies between the English and Chinese versions, the English version shall prevail.
